Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Leroy Labs LLC ("Flock", "we", "us", or "our") and govern your use of the Flock mobile app and the flock.picswebsite (together, the "Service"). Please read them carefully.
1. Acceptance of these Terms
By creating an account, joining an event, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and age
You must be at least 13 years old to use the Service. By using Flock you represent that you are 13 or older and that you are able to enter into these Terms. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian.
3. Your account
You are responsible for the information you provide, for activity that happens under your account, and for keeping your sign-in secure. Provide accurate information and let us know promptly if you believe your account has been used without your permission.
4. License to use Flock
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service except as permitted by law.
5. Acceptable use
You agree not to use the Service to:
- upload or share content that is sexually explicit, depicts child sexual abuse, or sexualizes minors;
- harass, bully, threaten, defame, or invade the privacy of any person;
- post hateful, discriminatory, violent, or otherwise objectionable content;
- upload content you do not have the right to share, or that infringes anyone's intellectual-property or other rights;
- impersonate any person or misrepresent your affiliation with anyone;
- scrape, harvest, or bulk-download content, or use the Service to spam or solicit other members;
- attempt to break, disrupt, overload, or gain unauthorized access to the Service or its security.
Our Community Guidelines describe what is and is not allowed in more detail and are part of these Terms.
6. Your content
You retain ownership of the photos, videos, and other content you add to Flock ("Your Content"). You grant Flock a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely as needed to operate and provide the Service — for example, showing it to the other members of the same event and creating backups. This license ends when you delete Your Content or your account, except for copies retained as required by law or already shared with other members. We do not use Your Content for advertising.
When you contribute to an event, other members of that event receive a limited license to view and download Your Content for their own personal, non-commercial use. You are responsible for having the right to share what you upload and for respecting the privacy of the people in your photos.
7. No tolerance for objectionable content or abusive users
There is zero tolerancefor objectionable content or abusive behavior on Flock. We may review reported content, remove any content that violates these Terms or our Community Guidelines, and suspend or terminate the accounts of members who post objectionable content or behave abusively, with or without notice. We act on reports within a reasonable time. To the extent your use of the Service is governed by it, Apple's standard Licensed Application End User License Agreement also applies.
8. Reporting and blocking
If you see content or behavior that violates these Terms, you can report it from within the app on any photo or member. You can also block another member, which prevents you from seeing their content and them from seeing yours. We rely on these tools to keep the community safe and encourage you to use them.
9. Copyright and the DMCA
We respect intellectual-property rights and expect you to do the same. If you believe content on Flock infringes your copyright, send a notice to legal@flock.pics that includes: a description of the work and the allegedly infringing material and where it is located; your contact information; a statement that you have a good-faith belief the use is not authorized; and a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act on their behalf. We respond to valid notices, provide for counter-notices, and terminate the accounts of repeat infringers.
10. Payments
Flock is free to start. Optional per-event upgrades are one-time purchasesprocessed through the Apple App Store and are subject to the App Store's terms. Per-event upgrades are not subscriptions. Prices may vary by region, and the App Store is the source of truth on price at the time of purchase. Except as required by law or App Store policy, purchases are non-refundable.
11. Termination and account deletion
You can stop using the Service at any time and can delete your account from within the app (Profile → Delete account); deleting your account removes your account and associated personal data as described in our Privacy Policy. We may suspend or terminate your access if you violate these Terms or to protect the Service or its members.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, secure, or error-free.
13. Limitation of liability
To the maximum extent permitted by law, Flock will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or US $50.
14. Indemnification
You agree to indemnify and hold Flock harmless from any claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or the rights of any third party.
15. Third-party services
The Service relies on third parties, including your chosen sign-in provider and the Apple App Store. Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules. Before filing any claim, you agree to first contact us at legal@flock.pics so we can try to resolve it informally. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in the State of Delaware, United States, and you consent to personal jurisdiction there.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Service after an update means you accept the updated Terms.
18. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with our Privacy Policy and Community Guidelines, are the entire agreement between you and Flock regarding the Service.
